The Jackson Reforms will take effect on 1 April 2013. For legal proceedings started after this date, successful claimants will lose the ability to be reimbursed success fees arising under “no win no fee” conditional fee agreements, and “after the event” insurance premiums (for cover taken out once a dispute has arisen to insure against having to pay the opponents legal costs) from a losing defendant. The reforms will not be retrospective, so there is a limited “window of opportunity” in which to review whether your organisation has a claim to be pursued before the abolition of a costs regime which is extremely favourable to claimants with genuinely good claims.
