An order brought in under the Equality Act 2010 provides two statutory question and answer forms for claimants and respondents which may be used when seeking information about potential discrimination (in all types of discrimination cases) or potential inequality of terms (equal pay cases). Although, as is the position currently, it is not compulsory to use the forms, they are a useful template for those seeking to obtain information relating to discrimination or equal pay claims.

The order also provides that, in order for the information to be used at a hearing, any questions must be served either:

  •  Before proceedings are commenced.
  •  Within 28 days of commencement of proceedings.
  • Such later time as the court or tribunal permits.
