On October 18th, the Massachusetts Supreme Judicial Court ("SJC") held that the purchaser of a home that had been improperly foreclosed upon lacks standing to bring a quiet title action. The instant purchaser had bought the home which was the subject of an earlier SJC opinion in which the Court held that a lender who forecloses before being assigned or recording the mortgages does not take title to the home.
