On 26 October, the European Commission adopted a Notice providing guidance to Member States on speedier and more effective recovery of unlawful State aid. The guidance is intended to improve the level of enforcement and ensure that money is recovered within the specified deadlines. The Notice also deals with the rules applicable to insolvent beneficiaries. In line with the Degendorff case, where Member States fail to implement a recovery decision the Commission can demand the suspension of any new aid to a beneficiary until incompatible aid is recovered (even where the grant of the new aid is compatible with the rules).
