The Community Trademark of Alicante ruled a decision on April 26, 2013 confirming the notoriety and distinctiveness of the trademark shoe “PELOTAS” which  is the best selling of the Spanish company Camper achieving 12.000.000 pairs of shoes number of sales. 

The infringer shoe model, made  by a Spanish company acting in the same field of activity,  was confusingly similar to the 3D registered Community Trademark PELOTAS even if it was identified by a different mark.  Moreover the Court has established the obligation of withdrawing from the market all the infringing products and the destruction of the production moulds. The defendant should also proceed with the payment of an economic compensation amounting to 6% of sales of the shoes and  the publication of the decision through national media.
