Forty Ukrainian high level public servants, including Deputy Ministers and the chairmen of various regulatory authorities, have been dismissed as a result of the entering into force of the Law of Ukraine “On the Cleansing of Government” (the “Lustration Law”) on 16 October 2014. The Lustration Law is a key part of the Ukrainian Government’s recent anti-corruption drive, which also includes the passage by the Verkhovna Rada last week of an anti-corruption package of laws.
According to the Lustration Law, public servants holding senior positions in the administration of former President Viktor Yanukovich will be dismissed and are subject to a ten-year ban on holding public office, with the exception of elected positions.
Although a blunt instrument capturing both corrupt officials tied to the previous regime, as well as career civil servants, the Lustration Law is nevertheless viewed by the parliament and civil society activists as the only effective way to bring public accountability to Ukrainian governance.
Names of the dismissed officials will be published on the website of the Ministry of Justice of Ukraine. If by the time of entry into force of the Law, the official who is subject to lustration has been already dismissed or voluntarily resigned ahead of the order for his/her dismissal, the Ministry of Justice of Ukraine includes the name of such ex-official to the Unified State Registry of Lustration.
