The defendant was ordered to pay the claimant’s costs of a quantum hearing on an indemnity basis following their conduct at trial. This included the fact that accusations towards the claimant of deliberately exaggerating her symptoms were made despite the fact that there was no medical evidence to support this. Although it was appropriate for the defendant to examine the extent of the claimant’s injuries the manner in which the case was conducted (which included accusations in their counter schedule and the prolonged cross examination of the claimant and her witness) went far beyond this.
