The Supreme Court has agreed to review the largest employment discrimination case in U.S. history. In Wal-Mart Stores v. Dukes, 131 S. Ct. 795 (Dec. 6, 2010) (granting cert.), the plaintiffs allege that Wal-Mart discriminated against women by paying them less than men and by giving them fewer opportunities for promotion. The Court will decide whether the plaintiffs can bring a nationwide class action for back pay and punitive damages on behalf of approximately half a million current and former female employees. Oral argument is scheduled for March 29, 2011.
