Supplemental examination recently took affect under the America Invents Act (AIA). This new provision provides a pathway to strengthen a patent by presenting new information for the U.S. Patent and Trademark Office to consider after a patent is issued. However, supplemental examination can also be a risky move as it could potentially raise new questions about patentability. Finnegan partner M.
