On 29 October 2010, the High Court refused an application by Alstom to grant an interim injunction to prevent Eurostar from awarding a contract to Siemens for ten new high speed trains. Alstom’s principal allegation relates to the acceptance by Eurostar of a bid using a power system that is not currently approved for use through the Channel Tunnel. The High Court considered that Alstom has a serious case to be considered at trial. However, it was unlikely that Alstom would be able to demonstrate at trial that it would have secured the contract, even in the absence of the alleged breaches of the Public Contracts Regulations 2006. Consequently, the balance of convenience was not in favour of granting an injunction which would suspend the purchase of new rolling stock. The full trial is expected to commence in October 2011.
