Where a director and major shareholder of the claimant company had personally funded and conducted parts of the litigation, a third-party costs order was made against him personally under s51 Supreme Court Act 1981. He had a real interest in the outcome of the action since a victory would have shortcircuited the application against him for disqualification – Brampton Manor (Leisure) Ltd v McLean.
