The projects, industrial facilities or any other private activity, will be preceded by an environmental impact assessment (EIA), which allows to prevent possible negative effects to the environment, due to the public interest on protecting the environment, which will entail to the granting of the corresponding environmental license for each specific project by the Ministry of Natural Resources and Environment or Municipal Division of the Environment for specific cases, in accordance with the provisions of article 5 of the General Environmental Law. Obtaining the environmental license will be related to the compulsory compliance measures included in the resolution of the same, within which the obligation to present the Report on Compliance with Environmental Measures (ICMA) will be included in the terms established for each specific case, generally presented annually.

Failure to present them in a timely manner is considered an administrative fault, sanctioned as established in article number 124-a and 112 of the General Environment Act Regulation. The fine will be between L.100,000.00 to L.200,000.00, under Legislative Decree No.133-2018 which was published in the Official Gazette on February 26 of the current year. The amnesty is regulated in the payment of fines for the non-presentation or extemporaneous presentation of the Report of Compliance of Environmental Measures (ICMA), thus being able to accede to the same the projects framed under categories 1, 2, 3 and the projects that are catalogued as low impact, that they have not caused damages to the atmosphere or if they’ve done any damage, they have been repaired to satisfaction of the environmental authority. The validity of the amnesty period is six months from the date of publication and the companies that choose to benefit from the related benefit will not be sanctioned due to the extemporaneous presentation of the compliance report, achieving compliance with this measure, benefiting various sectors, among them the coffee, tourism, hospitality, infrastructure, hydrocarbons and other applicable commercial and industrial sectors.
