LabMD’s seemingly quixotic attempt to knock the Federal Trade Commission off its cybersecurity horse was dealt another blow this month. LabMD had asked the U.S. District Court for the Northern District of Georgia to enjoin the Commission’s ongoing administrative action concerning the company’s data security practices. But the court has granted the FTC’s motion to dismiss LabMD’s suit for lack of jurisdiction. The FTC’s administrative enforcement action will now proceed. The result of that action seems fairly predictable. The question is, will cybersecurity’s Man of La Mancha then continue “to fight the unbeatable foe” in a federal court of appeals?
