Purchasers of industrial or commercial properties are familiar with CERCLA`s requirements for All Appropriate Inquiry (AAI), but these requirements, and the ASTM standard commonly used to address them, do not always fit when purchasing undeveloped rural property. In December, EPA published a direct final rule amending its AAI regulation to ease requirements for Forested Land and Rural Property. EPA`s new rule references the existing ASTM Standard E2247-08 for Phase 1 Environmental Site Assessment Process for Forested Land or Rural Property. The proposed amendment will become effective March 23, 2009 without further EPA notice.
