In our February 23, 2009 Update, we reported that the Abusive Work Environment Act (the “Act”) was introduced in the Illinois House of Representatives. The purpose of the Act was to (1) provide legal relief for employees who have been harmed psychologically, physically, or economically by being deliberately subjected to abusive work environments and (2) provide legal incentive for employers to prevent and respond to abusive treatment of employees at work.  

On March 18, 2009, Representative Art Turner, the main sponsor of legislation, introduced a proposed amendment that would limit the Abusive Work Environment Prevention Act to all public employers, including state and local government entities, State universities, and community colleges, thereby removing private employers from the provisions.
