In the case of San Ling Chinese Medicine Centre v Lian Wei Ji, the employer tried to argue that the employee's employment contract was illegal and, therefore, that a tribunal had no jurisdiction to hear her unfair dismissal claim. It claimed that she had been working in breach of immigration rules. The EAT held that in this case, the employee had not knowingly participated in the illegality. Therefore the contract was not tainted by illegality and was enforceable.
