The new Unified Patent Court (UPC) and the Unitary Patent (UP) system are scheduled to kick off on June 1, 2023, with the Sunrise Period for requesting “opt outs” beginning March 1, 2023. In addition to providing an overview of the UPC and the UP system, this presentation included the pros and cons of opting patents out from the exclusive competence of the UPC, as well as possible strategies regarding granted European patent (EP) cases, pending cases, and future filings. We discussed filing and prosecution strategy in Europe and how to leverage the new opportunities given by UPs and the UPC.
