An employer filed an application for labor certification on behalf of the position of head teacher which was denied on the grounds the job order showed a wage range below the prevailing wage determination. On appeal the Board of Alien Labor Certification of Appeals (BALCA) stated that to the extent an employer includes a wage range to advertise an opportunity, it may not advertise a rate lower than the prevailing wage and this standard applies to all advertising (Matter of Red Apple Child Development Center, 2009-PER-00472); BALCA 6/29/2010); 87 IR 1379, 7/12/2010).
