The U.S. Court of Appeals for the Third Circuit has granted Wyndham Hotels and Resorts permission to file an early appeal of a district court’s ruling upholding the Federal Trade Commission’s authority to bring an enforcement action over the company’s allegedly shoddy data security.  This will be the first time an appellate court will decide whether the FTC has the authority to police companies’ data security practices under its broad mandate to go after “unfair or deceptive acts or practices.”
