On 29 January 2010, details were published of appeals lodged with the European Court of Justice (“ECJ”) by Arkema France SA and its parent company Elf Aquitaine SA. The companies are appealing against judgments of the General Court that dismissed their appeals against the Commission's decision on an illegal cartel in the market for monochloreacetic acid (“MCAA”). Both companies raise arguments challenging the approach taken by the General Court in assessing the attribution of liability to a parent company for the anticompetitive actions of its subsidiary.
