The European Commission (Commission) confirmed on 29 December 2008, that the French energy group, EDF, has received a Statement of Objections setting out its concerns over conditions imposed in contracts concluded by EDF with industrial customers in France. The Commission’s letter sets out its concerns that EDF may be abusing a dominant market position in breach of Article 82 of the EC Treaty. The allegations include the fact that the duration of the exclusivity that EDF enjoys under the contracts may be unduly limiting customers from switching to other providers and, in addition, there appear to be restrictions upon the resale of electricity. It is alleged that these practices may have made it difficult for suppliers to enter and expand the French electricity market. EDF will now have an opportunity to respond to the Commission’s concerns before the Commission takes any final decision on the outcome of its investigation.
