Those with facial hair might be interested to know that a US lobby group has been formed to act on behalf of people who feel they have suffered discrimination because they have moustaches. The American Moustache Institute, who aim to create a climate of acceptance and understanding for moustache-wearing American men, claim they are fighting against real discrimination, such as when people feel they have to shave before a job interview. The bias is found in high places. Last month, the US Supreme Court ruled that it is permissible for a trial lawyer to throw someone off a jury on the basis of his facial hair. While unfair treatment of UK employees because of facial hair would not currently give rise to a stand alone claim, it could form the basis of other claims including discrimination on the grounds of age or religious belief. Those without facial hair may be disappointed to hear that we believe the Employment Equality (Moustache Discrimination) Regulations are still some way off.
