The first three areas currently under review are as follows:

  1. Revised version of the Control of Substances Hazardous to Heath Regulations 2002 (as amended) ACOP – changes include revision of the text to make it easier for duty holders to understand and comply with their duties, clarification of the requirements of Regulation 9 which concerns thorough examination and test of control measures.   2.  Proposal to publish an updated ACOP on Legionnaire’s disease. Changes include clarification of advice in relation to low risk scenarios and practical advice on the legal requirements of the Health and Safety at Work Act and Control of Substances Hazardous to Health Regulations 2002 in relation to risk from exposure to legionella bacteria.   3. Proposal to consolidate the ACOP on the Dangerous Substances and Explosive Atmosphere Regulations 2002 on various aspects – changes include greater clarity and increased use of “at a glance” lists and an emphasis on proportionality and the avoidance of the production of risk assessments which overlap. The fourth consultation is regarding revisions to the Approved Code of Practice for Managing and working with asbestos. The proposal is to consolidate two ACOPs (L143 and L127) and take into account the Löftsedt review, which highlighted the need to simplify employers’ understanding of their obligations. Amendments include the revision of materials supporting various regulations to reflect changes of the law in notification of non-licensed work with asbestos and segregation of asbestos work areas. A further change is simplification of what employers are required to provide by way of information, instruction and training of their employees.
