In November, we reported on the introduction of the Innovation Act of 2013 in the U.S. House of Representatives. The House bill, which passed in December, offered a potential solution to what can be oppressive patent litigation initiated by patent trolls against small businesses.

Unfortunately, the patent reform envisioned by the Innovation Act is unlikely to be realized. Senate Judiciary Committee Chairman Pat Leahy stated that the reform measures of the Innovation Act will be tabled. In the fight against patent trolls, one issue that had not been adequately addressed was how to remedy unintended consequences to legitimate patent holders.
