We are approaching the peak of the consultation season. As well as the Gibbons review of the statutory dispute resolution procedures, open consultations include:

  • Statutory paternity pay: the Department of Trade and Industry (DTI) is exploring how best to implement the provisions of the Work and Families Act, which will allow mothers to transfer up to six months of their maternity leave to the child’s father.
  • National minimum wage: the DTI is consulting on strengthening the enforcement regime for the national minimum wage.
  • Illegal workers: the Home Office is exploring the appropriate levels of penalties for employers who engage illegal migrants. It suggests that directors and managers of the employer would face a prison sentence of up to two years or an unlimited fine for the most serious offence.
