On November 2, 2019, the Salvadoran Technical Regulation: Wastewater, Wastewater Quality Parameters for Discharge and Waste Sludge Management (RTS 13.05.01: 18) came into effect. Subsequently, on November 6, 2019, the Special Regulation on Wastewater and Waste Sludge Management came into effect. These regulations establish certain obligations for the owners of wastewater treatment systems that must be fulfilled in accordance with the following deadlines:
- According to article 34 of the Special Regulation of Residual Waters and Waste Sludge Management, the owners who, upon the entry into force of the regulation, have an environmental permit and a wastewater treatment plant, must submit to the Ministry of Environment and Natural Resources, the Adjusted Environmental Management Program in relation to wastewater treatment and sludge management, within one year. This period expires on November 6, 2020.
- In accordance with article 5.1.4 of RTS 13.05.01: 18, the activities or projects that have an environmental permit upon entry into force of RTS 13.05.01: 18, whose wastewater treatment systems do not comply with the Minimum withdrawal distances established in section 5.1.3, have a period of one year to present the Adjusted Environmental Management Program or a technical study in which it is demonstrated that there is no affectation in that respect, in order to continue operating. The deadline to fulfill this requirement expires on November 2, 2020.
Therefore, we remind our clients to take note of these deadlines in order to comply with the provisions of the aforementioned regulations.
