The Supreme Court of Canada announced yesterday that it will release its decision in response to the members’ appeal of the Ontario Court of Appeal’s decision in Kerry (Canada) Inc. v. DCA Employees Pension Committee on Friday August 7, 2009. This decision may have significant impact, as it will consider whether plan sponsors can pay plan administration expenses out of the plan fund and use surplus in the defined benefit component of a pension plan to fund (crosssubsidize) its contributions to the defined contribution component of the same plan.
