The Court of Justice of the European Union has delivered its judgement in the case of Association Belge des Consommateurs Test-Achats and others (Case C-236/09). This case involves a challenge by a Belgian consumer group of an opt-out under European law (reflected in Irish legislation) permitting insurance companies to use gender as a rating factor. The Court of Justice of the EU (the CJEU) ruled on 1st March that taking the gender of an insured individual into account as a risk factor in insurance contracts constitutes discrimination but provided for a transition period allowing the opt out to remain valid until 21 December 2012
