The Competition Commission (CC) has prohibited BOC Limited (BOC) from purchasing the packaged chlorine business of Ineos Chlor Limited (Ineos). Although the market concerned was relative low value, the Office of Fair Trading (OFT) considered the competition issues serious enough to have made a reference to the CC in May 2008. In December 2008, the CC provisionally concluded that the removal of Ineos from the market could lead to higher prices and/or poorer service levels. More recently, the CC published draft undertakings prohibiting BOC from buying any material assets of Ineos' packaged chlorine business without the OFT's permission for 10 years. The undertakings extend to the acquisition of any company having control of Ineos' packaged chlorine business and the acquisition of Ineos' assets which would result in the transfer of control of Ineos' activities. The CC has invited comments on the draft undertakings from interested parties by 5 March 2009, before these are finalised.
