The Equal Opportunity Act 2010 (Vic) commenced on 1 August 2011, replacing the previous Equal Opportunity Act 1995 (Vic).

Employers should carefully consider the requirements and obligations under the new regime.  In particular, employers should be aware of the positive obligation to:

  • take reasonable measures to eliminate discrimination, sexual harassment and victimisation in the workplace; and
  • make reasonable adjustments for impaired employees.
