The Health and Social Care Act 2008 establishes a new body in England and Wales, the Care Quality Commission, to be known as the CQC. The Commission for Social Care Inspection, the Healthcare Commission and the Mental Health Act Commission will all be abolished. The CQC will take over the function of these bodies including responsibility for monitoring the welfare of detained mental health patients. Under the Act, care homes will be required to act compatibly with the Human Rights Act 1998, where people are placed in residential accommodation under Part III of the National Assistance Act 1948.
