Following the introduction of the new Bribery Act 2010 in the UK, the rules on exclusion from selection for public and utilities tenders have been updated. The Bribery Act introduces several categories of offences: (i) offering a bribe (‘section 1 offence’); (ii) accepting a bribe (‘section 2 offence’); (iii) bribing a foreign public official (‘section 6 offence’); and (iv) a corporate offence of failing to prevent bribery (‘section 7 offence’). The Public Contracts Regulations 2006 and Utilities Contracts Regulations 2006 have been amended to include a provision the mandatory exclusion of bidders who have committed a criminal bribery offence under sections 1 or 6 of the Bribery Act 2010.
