Changes to the Race Relations Act 1976 came into force on 22 December 2008 by virtue of the Race Relations Act 1976 (Amendment) Regulations 2008.  

The amendment aims to protect the position of the 'deterred applicant', i.e. a person who is put off applying for a role due to an implication that he or she will be discriminated against. The amendment does not however apply to hypothetical situations because the claimant must establish that there is an actual disadvantage. Therefore the amendment will not apply, for example, where an individual is not qualified to apply, or has no intention of applying, for the role in question.
