In 2002, Shanghai implemented the medical liability insurance system.  Since then, more than 400 hospitals in Shanghai have participated in the system and 13,463 claims have been filed and recorded in the first 10 years following implementation.  Among these claims, some of them have been successfully resolved, while many of the claims have not been dealt with satisfactorily.

In response to this concern and with a view to improve the existing system, the Shanghai Healthcare Planning Commission plans to set up a medical liability insurance pool for medical practitioners in Shanghai.  The pool will be managed by an independent claims processing centre, which will be responsible for handling and assessing the compensation in each claim.

The Shanghai Healthcare Planning Commission will organize a public tender to select four to five reputable insurers to cover the pool.  If the plan is successfully implemented, all public hospitals in Shanghai will become participants of the pool.
