Regulations for monitoring and reporting hospitals and care homes concerning their application of the Mental Capacity Act 2005 relating to the deprivation of liberty of residents.
The duty to monitor rests with the Care Quality Commission who must report to the Secretary of State when required to do so. The Commission may visit and interview residents of hospitals and care homes and inspect records for the purposes of monitoring and reporting.
