A Franchise Alert dated July 27, 2009 advised that the Federal Trade Commission (FTC) would begin enforcing the Red Flags Rule, 16 CFR Part 681, on August 1. On July 29, the FTC announced that it would postpone for a third time enforcement of the Rule. Accordingly, "creditors" now have until November 1, 2009 to comply with the requirements of the Red Flags Rule. In announcing the deadline extension, the FTC indicated that it will "redouble its efforts" to provide "additional resources and guidance to clarify whether businesses are covered by the Rule and what they must do to comply."
