MidAmerican Energy Co. has announced that it settled a Clean Air Act (CAA) citizen suit brought by the Sierra Club. Sierra Club v. MidAmerican Energy Co., No. 13-CV-21 (S.D. Iowa 1/22/13). The Sierra Club had alleged that various company operations at a number of its Iowa facilities emitted pollutants in excess of limits established in permits enforceable under the CAA. The settlement admits no wrongdoing, but the utility agrees to cease burning coal in seven boilers by April 2016. The settlement allows MidAmerican to convert at least some of those boilers to combust natural gas. Also under the settlement, the utility agrees to complete emission control improvements (adding baghouses) for two coal-fired boilers at a plant in Sergeant Bluff, Iowa, by the end of 2014.
