California Senate Bill 1456 proposes a process for mediation proceedings in California Environmental Quality Act (“CEQA”) cases. The mediation would be conducted concurrently with any CEQA judicial proceedings. Specifically, it authorizes a CEQA petitioner to request mediation within five business days from the date of the filing of a notice of determination. The request would be deemed rejected if the lead agency does not respond within five business days. The bill recently passed in the California Assembly’s Natural Resource Committee.
