The English and Scottish Law Commissions recently opened a consultation on proposed clauses for an Insurance Contracts Bill in the UK. Amongst other matters, the proposed clauses deal with (a) disclosure and representations by insurers, (b) damages for late payment of claims, (c) insurers’ remedies for fraudulent claims and (d) the issue of good faith. The consultation period closed on 21 February 2014 and it is expected that the final report and draft Bill will be published during the summer.
