The Competition Appeal Tribunal (the Tribunal) is considering determinations made by the Competition Commission before giving a final ruling in the appeal by the Carphone Warehouse against the Office of Communications (Ofcom).

The Carphone Warehouse appealed to the Tribunal after Ofcom imposed price controls on BT Openreach’s wholesale line rental (WLR) and local loop unbundling (LLU) charges. The Competition Commission found that certain errors and misjudgements were made by Ofcom in assessing efficiency levels and applying price controls in relation to LLU charges, but rejected arguments that there had been any such errors in relation to WLR. The Tribunal will now consider the changes and remedies suggested by the Commission in its determination before making the final decision.
