R (Mary George Ltd) v CQC  EWHC 1341 (Admin)
A care home proprietor challenged the findings in a CQC report, and challenged the local authority’s decision to refuse to effect referrals to the home. The CQC had made negative findings, and the local authority had then suspended all referrals to the home pending resolution of the concerns.
The claim involved a Wednesbury challenge to the CQC’s findings. The Court rejected that challenge in strong terms: it was no more than a dispute as to the findings.
The challenge to the local authority’s decision was out of time and the Court declined to extend time. In any event the challenge was a hopeless one.
