As a warning to all employers whatever the nature of their business or operations, TPR has fined a football club for failing to comply with auto-enrolment obligations. Swindon Town is a League 1 club owned and managed by former Norwich City footballer Lee Power. It has received a fine of £22,900 after it "repeatedly failed to comply with its automatic enrolment duties".
TPR stated that it had issued Swindon Town with a compliance notice on 18 August 2014 requiring the remedial steps of automatic enrolment of employees and the payment of contributions. Swindon Town reportedly failed to comply with these instructions by the deadline of 17 October 2014.
Importantly for employers, TPR has underlined several further delays by Swindon Town which prompted it to adopt a more forthright approach and change its intervention from remedial to enforcement. In light of this, we advise any employer struggling to discharge its duties to seek advice and approach TPR if necessary. Indeed, TPR has expressed its view that other employers should “learn lessons” from this case and not ignore their duties but ask for help if needed.
