On 7 May 2019, the Competition and Consumer Protection Commission (“CCPC”) published guidelines for contracts for care for nursing homes. The guidelines set out the obligations and responsibilities that nursing home providers must adhere to under consumer protection law and aim to provide greater transparency, clarity and certainty for consumers.
The guidelines are not necessarily newly established rules as they build upon existing rules regulating unfair terms as set out in consumer protection law in Ireland. These guidelines have been created to clarify unfair terms in the context of nursing homes and were created on foot of a review in which the CCPC found examples of unfair terms and technical language currently being used in the market.
The CCPC has stated that nursing homes across Ireland will receive these guidelines in the coming days and will be required to review their standard form contracts of care to ensure compliance with consumer protection law. The CCPC will then assess compliance in the sector after allowing a period of time for changes to be made.
Additionally, the CCPC has published an accompanying information booklet for consumers to assist with identifying unfair terms in nursing home contracts and has provided a template letter for consumers to raise their concerns with a nursing home provider.
