On June 16, 2008, without prior notification, the USCIS released a new edition of Form I-9 and mandated its immediate use. That form had a revision date of June 16, 2008 and an expiration date of June 30, 2009. However, since the content of the new form did not contain any changes from the prior version of the form, which had a revision date of June 5, 2007, the USCIS decided that the revision date did not need to be changed, but the expiration date did. Consequently, the latest version of the form I-9 bears a revision date of “06/05/07,” and an expiration date of “06-30-09.”

If an I-9 bearing the June 16, 2008 revision date was used by an employer during the hiring or reverification process, it will be considered a valid form.
