On Dec. 2, 2008, the EPA and the U.S. Army Corps of Engineers (Corps) issued a guidance document revising the Agencies` 2007 guidance on what ``waters`` the Agencies will assert jurisdiction over under the Federal Clean Water Act (CWA) and those features that are not ``waters`` that fall under the jurisdiction of the CWA, based on the U.S. Supreme Court`s decision in the consolidated cases of Rapanos v. United States and Carabell v. United States. In this revised guidance, EPA and the Corps also attempted to clarify the reach of ``traditional navigable waters, `` and the terms ``adjacent wetlands`` and ``relevant reach.``
