The First Chamber of Parliament has approved an amendment of the Dutch Telecommunications Act creating a national “Do-not-call register”, which will be in force as of 1 October 20095. Pursuant to this amendment, all companies using telemarketing are obliged to consult the register prior to contacting any individual and, if an individual objects to being contacted during a phone call, include such individual in the register. The Dutch Independent Postal and Telecommunications Authority will enforce compliance and may impose fines for infringement up to EUR 450,000.
