Check out the below Vlog on two recent cases relating to the same property in Northwood. The first case was the Court of appeal decision in Ross v Lane Cove Council [2014] NSWCA 50. The second case was Lane Cove Council v Chami [2014] NSWLEC 18.

These cases are interrelated, but have different implications. The Ross decision highlights the importance of correctly joining all relevant parties to a set of proceedings which involve an order to demolish or reinstate a building. The Chami decision highlights the importance of obtaining an Occupation Certificate if occupation of a building is sought, and the need for compliance with the Building Code of Australia (BCA), or the National Construction Code which comprises the relevant volumes of the BCA.
