The second instance of the Intellectual Property Court rendered a decision on July 31, 2013 to dismiss entirely the appeal filed by Jusung Engineering Co., Ltd., which accused Applied Materials, Inc. and AKT America, Inc. of violating the Fair Trade Act. The Court held that there was no violation by Applied Materials, Inc. or AKT America, Inc. and found that a patentee’s application for amending patent claims should not be taken as the patentee’s knowledge that the patent is invalid and its exercise of patent rights as violation of the Fair Trade Act.
