By means of the Law No. 237 of 2021, the Labor Code is modified to increase sanctions due to infringements related to the recruitment of foreign personnel without the corresponding authorization, establishing US$ 15,000 fines and provisional suspension of the company’s commercial license, in cases of relapse.

Furthermore, this Law creates a coercive jurisdiction within the Ministry of Labor and Employment Development, aiming to enforce overdue obligations from fines, penalties and damages caused to this entity’s property. 

Finally, this Law establishes mechanisms for appraising the payment of the Occupational Safety, Health and Hygiene Fund of State-owned and private construction works.
