The Stichting Voor Mijn Kleinkind (SVMK), which translates as Foundation For My Grandchild, is a foundation that assists grandparents with finding their grandchildren. In 2016, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP) found that the website of the foundation published personal data of minors without the consent of the parents, whereby violating the Dutch Data Protection Act (Wet bescherming persoonsgegevens, Wbp). The AP therefore warned the foundation that it will take enforcement actions against them if they do not rectify the violation. The foundation has now made the necessary changes, and the data on their website no longer relates to identifiable persons, nor does the children’s personal data appear in search engine results, as was previously the case.
The AP also took this opportunity to inform parents (and children over the age of 16) of their right to request website owners to delete information that relates to them.
